Each Cold Storage Needs Its Own Licence
Clause 4(4) of the Cold Storage Order 1980 provides that where an applicant proposes to construct more than one cold storage, or to expand more than one, a separate licence must be obtained for each by applying separately. An existing licence does not stretch to cover a new facility. This is the single most important thing to establish before drawing an expansion loan.
Settle the Licence Before Drawdown, Not After
A chamber built without its own licence cannot lawfully accept foodstuff for storage, because clause 3(b) permits storage only under and in accordance with a licence. That turns a financed asset into one that cannot earn. Sequencing the licence application alongside construction, rather than after it, protects both the project and the loan.
Your Staff Are Part of the Licence Assessment
Clause 6(iii) directs the Licensing Officer to have regard to the suitability of the qualifications and experience of the staff employed or proposed to be employed for manning the plant, alongside refrigeration, electrical, insulation, sanitary and safety conditions. Retaining technically qualified people is therefore a licensing matter, not only an operating one.
A Five Year Licence, Renewed by 31 October
Clause 11 provides that a licence expires on the 31st day of December of the fifth year from the year in which it is granted, and clause 12(1) requires renewal applications by 31 October. Diarise the renewal date well ahead, particularly where a term loan runs across it.
